Mold and Renter's Rights in Texas

In Texas, a landlord is legally required to remove mold from a rental property if:

  • the condition was not caused by the tenant, the tenant's family, or the tenant's guests; and

  • the landlord has proper written notice of the condition; and

  • the tenant is not delinquent in rent at the time of giving the landlord notice to repair or remedy

The written notice must be trackable like a certified letter or return receipt. The landlord has a reasonable amount of time to make the repairs. What is a reasonable amount of time?

Why is mold a problem in my house?

Moisture supports mold growth which can also cause wood rot and damage the structural integrity of your home. Exposure to damp and moldy environments may cause a variety of adverse health effects. Some people are not affected by elevated mold spores. For others, mold can cause a stuffy nose, sore throat, coughing or wheezing, burning eyes, or skin rashes. In 2004, the Institute of Medicine (IOM) found there is sufficient evidence to link indoor exposure to mold with upper respiratory tract infections in otherwise healthy people. In 2009, the World Health Organization issued more information regarding dampness, mold, indoor air quality, and illness.

What is a pre-purchase mold inspection?

It's an evaluation you can purchase before committing to buy a home. Typically, you'll add a mold inspection contingency to your purchase offer, ensuring you can back out of the deal if sources of moisture or mold growth are found.

What is mold?

Mold is a fungus and is ubiquitous meaning its everywhere. Mold produces spores which are like microscopic seeds. These spores float in the air and when they land on damp spots in your house, they may begin growing and eating whatever they land on. Common mold food source materials include the paper on your drywall, paint, wallpaper, carpet, wood studs, trim, cabinets, dust, and flooring.

Once the mold spore has food and water, it can germinate and produce more mold spores growing exponentially. Mold can grow within 24-48 hours. The key is to control the moisture in your home.

How do I prevent mold in my house?

  • Monitoring and controlling the moisture in your house is the key. Fix the source of the water problem or leak immediately.

  • Use your bathroom and kitchen exhaust fans to vent all that humidity to the outside, not your attic.

  • Vent your clothes dryer to the outside.

  • Monitor the humidity level in your home with a humidistat and keep it below 50% all day long.

  • Use a MERV 8 or better filter in your HVAC system

Are "black toxic" molds more harmful than other molds?

This question refers to the black toxic mold Stachybotrys chartarum made famous by the Melinda Ballard case in 2001.

This is a tricky question and the basis of most litigation cases...can you prove that a specific symptom was caused by that specific mold in that particular individual? There is a lot to be gained or lost based on the answer to this question.

The following info comes directly from the Centers for Disease Control website:

" At present, no test exists that proves an association between Stachybotrys chartarum and particular health symptoms."

"However, if Stachybotrys chartarum or other molds are found in a building, they should be removed."

"It is not necessary to determine what types of molds you may have growing in your home or other building. All molds should be treated the same with respect to potential health risks and removal."
